Qué duda cabe que la red de caminos públicos municipales supone la mayor reserva de suelo público de la que dispone un municipio, formando parte de su patrimonio y siendo elemento identitario de la idiosincrasia. Los caminos son memoria de la historia local y, aunque su función actual puede diferir de la inicial, hoy día son eje vertebrador del territorio e infraestructuras esenciales para el desarrollo económico y social de las administraciones locales.
Esta premisa de partida ha provocado que el ayuntamiento de Benahavís haya realizado un completo inventario de caminos municipales de uso público. Concretamente, se han catalogado de forma minuciosa y deslindado jurídicamente una totalidad de treinta y tres caminos. Si ya, en este proceso, el consistorio es pionero, qué duda cabe que se encuentra a la vanguardia en el trámite de inscripción y rectificación en sede catastral y registral.
No se trata de un proceso fácil pero el hecho de contar con las máximas garantías jurídicas (aprobación en pleno por unanimidad, exposición al público y notificación a colindantes) ha provocado que el dominio público viario se consolide por primera vez en el municipio y suponga un proyecto modelo a copiar por otras administraciones.

There is no doubt that the network of municipal public footpaths is the largest reserve of public land available to a municipality, forming part of its heritage and being an identifying element of its idiosyncrasy. Roads are the memory of local history and, although their current function may differ from the initial one, today they are the backbone of the territory and essential infrastructures for the economic and social development of local administrations.
This premise has led Benahavís Town Hall to carry out a complete inventory of municipal footpaths for public use. Specifically, a total of thirty-three roads have been meticulously catalogued and legally demarcated. If the municipality is already a pioneer in this process, there is no doubt that it is at the forefront in the process of registration and rectification at the cadastral and registry office.
It is not an easy process, but the fact of having the maximum legal guarantees (unanimous approval in plenary session, public exhibition and notification to neighbours) has meant that the public road domain has been consolidated for the first time in the municipality and represents a model project to be copied by other administrations.
